Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Drawello mobile application and website (the “Service”) provided by Drawello(“we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority, you must have permission from a parent or legal guardian.
License to use Drawello
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, or your internal business purposes where you hold the appropriate rights to the content you use.
Your account
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.
Your content
You retain ownership of the images and other content you upload (“User Content”). You grant us a limited, worldwide, royalty-free license to host, store, process, and display your User Content solely to operate and provide the Service to you (for example, to render your tracing overlays).
You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party or violate any law.
Acceptable use
You agree not to:
- Upload content that is illegal, infringing, or that you have no right to use.
- Upload content that is hateful, harassing, sexually exploitative, or violent.
- Reverse engineer, decompile, or attempt to extract source code from the Service, except where permitted by law.
- Interfere with or disrupt the Service, or attempt to gain unauthorized access to it.
- Use the Service to build a competing product, or resell or sublicense it without our permission.
Intellectual property
The Service, including its software, design, logos, and the built-in outline library, is owned by Drawello or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights.
Subscriptions, payments, and refunds
Some features require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play and renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your app store account settings. Refunds are handled by the applicable app store under its policies; we generally cannot issue refunds directly.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Limitation of liability
To the maximum extent permitted by law, Drawello will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.
Indemnification
You agree to indemnify and hold harmless Drawello from any claims, damages, and expenses arising out of your User Content or your violation of these Terms.
Termination
We may suspend or terminate your access to the Service if you violate these Terms or if necessary to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the jurisdiction in which Drawello is established, without regard to conflict-of-laws rules. Courts located there will have exclusive jurisdiction, unless mandatory local consumer law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
